General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all online Human Energetics services provided by Melissa Wurzinger to the client.

2. Description of Services

The services offered are provided within the scope of the Austrian regulated free trade of Human Energetics.

Human Energetics services are intended solely to support and harmonize the client's energetic balance and to promote general well-being.

The services offered do not constitute medical, psychological, psychotherapeutic, or physiotherapeutic treatment and do not replace diagnosis, treatment, or care by physicians or other legally recognized healthcare professionals.

No medical diagnoses are made, no therapies are provided, and no guarantees of healing or recovery are given.

3. Appointment Scheduling

Appointments are arranged by prior agreement only.

Sessions are conducted online via the mutually agreed communication platform.

The client is responsible for ensuring a stable internet connection and suitable technical equipment for participating in the session.

4. Prices and Payment

The prices agreed upon at the time of booking shall apply.

Unless otherwise agreed, payment must be made before the scheduled session by bank transfer or via the available payment methods.

5. Cancellation Policy

5.1 Individual Live Sessions

Individual sessions may be cancelled free of charge up to 24 hours before the scheduled appointment.

For cancellations made less than 24 hours before the appointment or in the event of a no-show, the full agreed fee will be charged.

5.2 Booked Written Sessions

For services booked in written form (without a live online session), cancellations, withdrawals, or refunds are not possible once the booking has been completed and the service has commenced.

6. Technical Issues

If an online session cannot be conducted due to technical problems on the part of Melissa Wurzinger, a replacement appointment will be arranged.

If technical problems on the client's side prevent the session from taking place, no refund shall be granted.

7. Liability

Participation in all sessions is voluntary and at the client's own responsibility.

To the extent permitted by law, liability for indirect or consequential damages is excluded.

Liability for intent or gross negligence remains unaffected in accordance with applicable law.

8. Data Protection

Personal data will be processed solely for the purpose of fulfilling the contractual relationship and in accordance with the applicable data protection laws.

Online sessions will not be recorded unless expressly agreed to in writing by both parties.

9. Right of Withdrawal for Online Bookings

Consumers generally have a statutory right of withdrawal for distance contracts.

If the client expressly requests that the service begin before the withdrawal period expires and acknowledges that the right of withdrawal expires once the service has been fully performed, the applicable statutory provisions shall apply.

10. Final Provisions

Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

These General Terms and Conditions shall be governed by the laws of the Republic of Austria.

The place of jurisdiction shall be the registered place of business of Melissa Wurzinger, to the extent permitted by applicable law.
